Also a very strange claim that pre-1989 material is legal. Note that it is common for attorneys to make multiple contradictory defenses and is standard and even acceptable practice. It is also common for prosecutors to claim material to be younger than it actually is, so what is characterized as "child pornography" may just be young looking models. Such was the case with the infamous Calvin Klein advertisements, poses of eighteen year old models which the religious right assailed as being child pornography.
