Supreme Court unanimous: quit fucking with Miranda

"The Supreme Court reaffirmed Monday that police must tell indicted people of their rights before starting interrogations. Justices ruled 9-0 in favor of a Nebraska man who claimed he was tricked into talking to officers who came to his house to arrest him on drug charges. The decision relieved civil liberties groups, which worried that the court was poised to roll back some of the protections in its landmark 1966 Miranda ruling... The Bush administration had argued that it was 'routine police practice' for officers to tell an indicted suspect that they wanted to talk about pending charges, like was done in the Fellers case." [So that means police are routinely violating Constitutional rights.]

"A federal judge has declared unconstitutional a portion of the USA Patriot Act that bars giving expert advice or assistance to groups designated foreign terrorist organizations... U.S. District Judge Audrey Collins said the ban on providing 'expert advice or assistance' is impermissibly vague, in violation of the First and Fifth Amendments... The case before the court involved five groups and two U.S. citizens seeking to provide support for lawful, nonviolent activities on behalf of Kurdish refugees in Turkey. The Humanitarian Law Project, which brought the lawsuit, said the plaintiffs were threatened with 15 years in prison if they advised groups on seeking a peaceful resolution of the Kurds' campaign for self-determination in Turkey."

"Dick Cheney, US vice-president, 'waged a guerrilla war' against attempts by Tony Blair, the British prime minister, to secure United Nations backing for the invasion of Iraq. Mr Cheney remained implacably opposed to the strategy even after George W. Bush, US president, addressed the UN on the importance of a multilateralist approach, according to a new biography of Mr Blair... The extent of Mr Cheney's opposition emerges in the biography of the British prime minister by Philip Stephens, the Financial Times' political columnist... Stephens writes that Mr Cheney's opposition to UN involvement left Mr Blair uncertain whether Mr Bush would go down the UN route until he uttered the relevant words in his speech to the UN general assembly in September 2002. One Blair aide remarked: '[Mr Cheney] waged a guerrilla war against the process . . . He's a visceral unilateralist.' Another agreed: 'Cheney fought it all the way - at every twist and turn, even after Bush's speech to the UN.'"

'In the case of Halliburton, as an example, they have an offshore subsidiary in the Cayman Islands. That subsidiary is doing business with Iran.' ... Halliburton is the company that Vice President Dick Cheney used to run. He was CEO in 1995 to 2000, during which time Halliburton Products and Services set up shop in Iran. Today, it sells about $40 million a year worth of oil field services to the Iranian Government. In the case of Iran, Thompson says they earn most of their revenues through their oil industry. So what is the connection between that oil business and terrorism and weapons of mass destruction? 'The Iranian Government is receiving dollars from it. And then turning around and exporting terrorism around the world. It benefits terrorism.'"

"White criminal offenders in Florida are nearly 50% more likely than blacks to get a 'withhold of adjudication,' a plea deal that blocks their felony convictions even though they plead to the crime. White Hispanics are 31% more likely than blacks to get a withhold. The disparity in outcomes has cost thousands of black offenders their civil rights, including the right to vote, serve on juries, hold public office, own a firearm. And the convictions carry an economic penalty: Felons can't be hired for many government jobs, and they can't apply for some student loans. 'Most prosecutors and some judges see the potential for salvation in a white defendant. With a black defendant, they see the destruction of a civilized society,' said H.T. Smith, a prominent South Florida criminal defense lawyer who is black... a Herald computer analysis of nearly 800,000 felony criminal cases from 1993 to 2002 found a system that is more likely to punish blacks than whites in the same predicament."
